Supreme Court Justice Clarence Thomas temporarily halted a lower court ruling requiring Sen. Lindsey Graham (R-S.C.) to testify in a Georgia grand jury investigation on the 2020 election.
It is not a ruling on the merits of Graham's case because Monday's stay from Thomas only temporarily blocks Graham's testimony.
Graham asked the high court to overturn a ruling by the 11th Circuit Court of Appeals, which denied his request to sit out the testimony in Fulton County, Georgia.
Donald McGahn wrote to the Supreme Court that Graham was protected from testifying because he was a sitting senator.
The investigation in Georgia is being led by the Fulton County District Attorney. Shortly after Trump asked the Secretary of State to find votes to reverse Biden's win, the investigation was launched. Graham is one of the Trump allies subpoenaed by the grand jury for testimony.
