A federal judge wrote that Trump knowingly pushed false claims of voter fraud during his presidential campaign.
In a post on his social media platform, Trump lambasted U.S. District Judge David Carter as a "partisan hack" and claimed that his loss to President Joe Biden was the result of a "rigged and stolen" election.
Carter ordered an attorney who tried to challenge Biden's win to turn over dozens of documents to the committee investigating the Capitol riot.
Emails show an effort by President Trump and his attorneys to push false claims in federal court for the purpose of delaying the January 6 vote, according to Carter.
Trump's attorneys were worried about citing evidence of voter fraud in Georgia. The same fraud allegations were made in a state court filing by Trump and his legal team.
The judge said that even though Trump signed a verification for the state court filing, he has since been made aware that some of the allegations have been incorrect.
The same inaccurate numbers were used by Trump and his legal team to file the complaint.
According to the judge, the emails show that President Trump knew the numbers of voter fraud were incorrect but continued to tout them. The court found that the emails were related to a conspiracy to cheat the United States.
The emails that Carter ruled were subject to the crime-fraud exception to legal privileges were part of a larger group.
Carter ruled that the crime-fraud exception also applied to emails showing Eastman and other attorneys for Trump suggesting that a "primary goal" of a court filing "is to delay or otherwise disrupt" the congressional vote to confirm Biden's electoral victory
While presiding over a joint session of Congress on January 6th, a former law school dean wrote a memo detailing a questionable legal strategy for Vice President Mike Pence to reject Electoral College votes for Biden.
Some of Trump's supporters chanted "Hang Mike Pence" as they swarmed the Capitol. The attack delayed the confirmation of Biden's victory.
Carter was called out by name by Trump.
David Carter keeps saying, and sending to all, very nasty, wrong, and ill informed statements about me on rulings, or a case, currently going on in California, that I know nothing about. Please explain to this partisan hack that the presidential election was rigged and stolen. He shouldn't say anything about me until he knows the facts.
The House committee that is investigating the January 6 riot must be given portions of the emails related to the plan for Pence. The panel voted last week to issue a subpoena to Trump.
The select committee subpoenaed messages from the Chapman email account in the late 2020s.
The Santa Ana, California, federal court was asked to stop Chapman from complying with the subpoena for his emails.
Carter ruled in March that the select committee should have access to 101 emails that were the subject of disputes. The judge wrote that it was more likely than not that President Trump tried to obstruction the Joint Session of Congress.
