Donald Trump is scheduled to give a deposition on Wednesday in a defamation lawsuit brought against him by an author who claims he raped her in a New York department store in the 1990s.
A federal judge in Manhattan rejected a request by Trump's lawyers to delay the deposition while a federal appeals court considers whether the case should be thrown out.
Kaplan ordered Trump to answer questions under oath from the attorneys. She was going to be deposed on Friday.
Kaplan said that Trump should not be allowed to run the clock out on the suit because he already is old.
Kaplan denied Trump's request to substitute the US government into the case on the grounds that the alleged defamation happened when he was president.
In a book excerpt published by New York magazine, it was stated that Trump raped her in a dressing room at Bergdorf in the mid 1990s.
She said Trump asked for advice on buying a gift for a girl after she ran into him.
Trump forced her into a dressing room in the lingerie department.
She wrote that the man pushed her against the wall when he lunges at her. He grabbed both my arms and pushed me up against the wall a second time, and as I became aware of how large he was, he held me against the wall with his shoulder and pulled down my tights.
More than 20 women have accused Trump of sexual harassment or assault.
He denies the accusations. Trump told a reporter that he didn't know about the rape claim and that she was not his type.
She then sued for defamation.
The former president is currently facing legal battles in numerous criminal and civil proceedings, including the Justice Department's investigation into his handling of classified documents found at Mar-a-Lago, as well as a state prosecutor's probe of efforts by Trump and his supporters to overturn the 2020 presidential election

A trial is scheduled for February 6. New York passed a law giving sexual assault victims a one-year window to file civil suits if the statute of limitations has expired.
The start of the window under the new law will be on November 24. The judge will be asked to try the two cases together.
