Smiles and Skittles

During a trial break on Wednesday, a prosecutor told the judge that a juror was flirting with another juror and that he might be flirting back. They smile and nod at each other, the prosecutor said, adding that when the juror looked at him, he shook his fists in the air.

The prosecutor was concerned about the juror.

The attorney conceded that he had also seen the two looks. He had an explanation for why he shook his hands.

His lawyer said that he was holding candy.

It's because of Skittles that the fist is shaking. Andrew said that his client is acting himself on his birthday.

I have seen her look. He's aware. He is not touching her. He isn't doing anything to encourage her. That's not a reason to get rid of this juror. She might like him, or she might not. There isn't a way to tell what the juror is thinking.

One of the defense lawyers objected to tossing the juror over the flirting allegations.

"Simply because a young woman is looking over here, it must be some flirtation involvement is just sexist," said a defense lawyer for Pete Musico. People have been laughing. The people are smiling during the trial. She's supposed to be looking over here.

Leonard Ballard, the defense attorney for Joe Morrison, was against the judge interviewing the juror.

When news of a potentially rogue juror came to light, the judge was able to interview the juror privately and ask her about her actions. He said he wouldn't do anything about it.

The trial is now into day eight and the prosecution is worried. Big Dan, the government's star witness, is going to testify. The FBI agent who worked with Big Dan was on the stand for seven days.

They are accused of providing material support for a terrorist act, including kidnapping the governor. They were members of a militia group called the Wolverine watchmen.

They are only charged with helping train the key players in the kidnapping plot because the FBI was able to foil it thanks to the help of undercover agents.

At 9 a.m., testimony will resume. The day is Thursday.
