A federal judge on Wednesday rejected Donald Trump's attempt to delay his deposition in a defamation lawsuit brought by an author who claims he raped her in a department store changing room in the 1990's.

The deposition of Trump, who has denied the rape allegations, is scheduled to take place on October 19th, five days after the deposition ofCarroll.

District Judge Lewis Kaplan of the Southern District of New York rejected Trump's attempt to delay the case on the basis that the defamation lawsuit is still unresolved.

Kaplan argued that the defamation suit was dependent on whether Mr. Trump raped her in a department store fitting room.

Kaplan denied Trump's bid to replace his name in the lawsuit with the " United States" because he was an employee of the United States when he made the allegedly defamatory remarks.

The lawsuit still needs a ruling from a federal appeals court in Washington D.C. to determine if Trump acted in the scope of his position as an employee of the United States.

The D.C. appeals court is still considering the case.

The New York Adult Survivors Act, which takes effect in November, will allow claims for rape to be revived even if the statute of limitations has expired. Roberta Kaplan said in a statement that she looks forward to filing the case under the Adult Survivors Act and moving forward to trial.
