A Freedom of Information Act request by the Heritage Foundation led to the discovery of documents that cast doubt on last year's controversy.

The Department of Homeland Security secretary Alejandro Mayorkas was aware that the popular narrative that Border Patrol agents whipped a group of Haitian migrants was false hours before he declared the incident "horrific" during a White House press conference. Less than three hours before the press conference, one of Mayorkas's staffers sent him an emailrelaying the account of photographer Paul Ratje, who said the salacious account of what happened was false.

Ratje was quoted as saying that he had never seen them whip anyone. When you look at the picture, it can be misconstrued.

Mayorkas perpetuated the misleading account of the incident by suggesting that something needed to be investigated.

Mayorkas said that they were addressing this with speed and force. The facts will drive our actions.

We won't cut a single corner in the investigation.

President Biden and other prominent Democrats regurgitated the media's account of the incident.

Biden said it was horrible to see people being treated like animals. I think it is outrageous. Those people will pay... There will be repercussions. It's a big deal. Beyond an embarrassment it is wrong. The Vice President said it reminded her of the time of slavery.

The conduct of Border Patrol agents was standard procedure according to George Syer. If a horse doesn't want to cooperate with its rider, it's a training aid.

The agents were put on administrative leave and then investigated by the U.S. Customs and Border Protection. Four agents were charged with endangering migrants after the investigation cleared them of whipping.

According to reports, Mayorkas has undermined the faith of Border Patrol agents. Many feel vulnerable due to the unraveling of the controversy and Mayorkas' involvement.

Brandon Judd told Fox News that border patrol agents are hesitant to do their jobs because they could be accused of a crime.

The Secretary hasn't responded to the latest revelation.
