According to The Washington Post, federal agents believe they have enough evidence to charge Hunter Biden with tax crimes and make a false statement in relation to the purchase of a gun.
The Post reported that it was up to the U.S. Attorney for Delaware to decide whether to prosecute Hunter.
According to the newspaper, federal agents decided months ago that they had a viable criminal case against the younger Biden.
Chris Clark, Biden's lawyer, said in a statement to NBC News that it is a federal felony for a federal agent to leak information about a grand jury investigation.
Clark said that the prosecutors in this case are diligently and thoroughly weighing not just evidence provided by agents but also all the other witnesses in the case. Prosecutors should not be rushed or criticized for their work.
Weiss was investigating Hunter's tax affairs.
The potential gun-related charge relates to Hunter filling out a federal form that asked if he was a user of or addicted to narcotics when he purchased a handgun in October of last year. According to a book that he later wrote, Hunter answered "no" when asked if he had used crack cocaine.
