Nick Kyrgios' lawyers will apply to have an assault charge against him dismissed because of his mental health issues.

There is an allegation of an assault on a former partner.

He could be sentenced to two years in prison if he is convicted.

Michael Kukulies-Smith reviewed his client's medical history and public disclosures of his mental health struggles in order to make the application.

If the accused is found to be mentally impaired, the court can dismiss the case.

The director of public prosecutions needs to approve cases thrown out on these grounds.

There will be a hearing on the application. Mr Kukulies- Smith said that his client spent a lot of time overseas.

The court heard that it was his preference for the hearing to take place as quickly as possible and for him to attend in person.

The tennis player, currently ranked number 20 in the world, has spoken about his mental health struggles in the past.

He insisted this week that the court case wasn't making it hard to focus on tennis.
