Texas Attorney General Ken Paxton fled his home to avoid being subpoenaed in a federal lawsuit that seeks to help Texans get out-of-state abortions.
According to an affidavit filed Monday in the U.S. District Court in Austin, Paxton ran from his home in McKinney, Texas, into a truck driven by his wife, state Sen.
The documents that were left on the ground by the house were not taken by the Paxtons.
There is a civil lawsuit in which multiple Texas-based nonprofits want to resume helping pregnant residents get abortions in other states. Paying for out-of-state abortion providers, providing financial aid to those seeking abortions, and providing interstate travel to those providers are all included.
The Supreme Court's decision in June to overturn the federal right to abortion had stopped the nonprofits from doing their abortion-related work. The Supreme Court threw out a case that had upheld the right to an abortion.
The media was attacked by Paxton for reporting on the affidavit without denying the substance of the document.
The media should be ashamed of themselves because this is a waste of time.
"All across the country, conservatives have faced threats to their safety," he said.
"It's clear that the media wants to drum up another controversy involving my work as Attorney General, so they're attacking me for having the audacity to avoid a stranger near my home and showing concern about the safety and well-being of my family," he said in a second statement
The affidavit said that he arrived at the house at 8:26 a.m. and was greeted by a woman who identified herself as "Angela." She told him that the AG was on the phone when he told her that he was going to deliver the subpoenas.
He offered to wait for Ken, who he said was inside the house through the window. According to the person who observed the black Chevy truck in the driveway, Paxton was in a hurry to get out.
The man said he saw the man exit his garage. He turned around and went back into the house through the same door in the garage after calling out his name.
Minutes later, she came out to the truck and opened both the driver's side door and the back door. After starting the truck, she saw Mr. Paxton RAN from the door in the garage to the rear door.
I called him by his name and said that I had court papers for him. The man ignored me and headed for the truck. I left the Subpoenas on the ground so Mr. Paxton could get them, after I decided that he wouldn't take the Subpoenas from my hand.
The documents were placed next to the truck. The service was done at 10:00 am. The documents were left on the ground after he got in the truck.
The Department of Health and Human Services told hospitals and doctors to perform abortions in emergencies.
The securities fraud charges against the attorney general have not gone to trial. He defeated George P Bush in the Republican primary.
