The GOP campaign strategist was asked to defend a claim about why the Supreme Court nomination of Garland was held up.

CNN analyst and onetime aide to former Arkansas Gov. Mike Huckabee, Alice Stewart, weighed in on Supreme Court Chief Justice John Roberts' recent comments.

The legitimacy of the Supreme Court was defended by Roberts in those remarks.

He said that he disagreed with Roberts.

The legitimacy of the court was undermined when the Republican Senate refused to consider Garland's nomination. McConnell cited a long standing tradition not to fill Supreme Court vacancies during an election year.

McConnell's claim was described as "misleading" by PolitiFact.

Lindsey Graham supported filling Supreme Court vacancies in election years which undermined the court's legitimacy.

The one that Garland wasn't given a hearing for, and the one that ConeyBarrett was seated a week before the election, were stolen by them. The legitimacy of the court was ruined by that.

Stewart claimed that the Garland nomination was held up because there was a divided government and Republicans were in control.

"That's not what McConnell said," he replied.

Stewart said that this has been the way for a long time. There is an inclination to wait when you have a divided government.
