Lawyers for Musk sent another letter to the company on Friday, this time claiming that a payment to a whistle blower was in violation of his agreement with the company.

The terms of Musk's deal with Peiter Zatko were broken by the $8.25 million agreement that was entered into by the social media company in June.

Regulators in the U.S. and Europe were alarmed by Zatko's claims that there were dangerous data privacy and security risks ignored by company leadership.

If Zatko's allegations are true, there would bematerial, if not existential, consequences for the company.

Since July 8, Musk has been trying to end the deal due to concerns about the number of fake accounts on the social network.

A request for comment from Forbes was not responded to.

"For the avoidance of doubt, these bases are in addition to, and not in lieu of, the bases for terminated employees," attorney Mike Ringer said in the letter.

Musk's offer to buy the company was accepted by the board, with Musk saying he would roll back moderation policies. There were cracks in the deal after Musk voiced concern about the claim that less than 5% of accounts are fake. According to the lawsuit, Musk wants out because of a decline in his wealth. The company's future ownership will be determined during a five day trial in Delaware. Zatko has been subpoenaed by Musk's team.
