In July, Musk said he was walking away from the deal to buy the micro-blogging site. The lawsuit was filed to force Musk to buy the company.
Musk was chastised by a judge for not handing over all the texts that were requested.
Musk's own production of text messages revealed glaring deficiencies, as third parties produced text messages that Musk himself did not produce.
Robert Steel, an investment bankers, appeared to be talking to Musk in one of the texts that was obtained from him.
Musk replied "Ok got it" after Steel asked him a question.
One would expect some evidence of Musk's response to be included in the document production of the defendants.
Musk's team was accused of being deficient and slow in producing a list of people who knew about the deal. During a pre- trial hearing on Tuesday, she said that efforts by Musk's team to identify parties involved in the deal were not optimal.
In her Wednesday opinion, she granted a request from Twitter to get company phone records for the texts sent by Musk and Birchall.
She allowed the allegations from Peiter Zatko to be added to the case. According to a complaint filed by Zatko, the former head of cybersecurity, the company lied to Musk about the number of bot on its platform.
