Michigan residents will vote on whether the state should protect abortion rights in the November elections, as the Michigan Supreme Court ruled Thursday to approve a ballot measure on reproductive rights after the Board of State Canvassers didn't safeguard abortion access in the state.
The abortion ballot initiative must be approved by the Board of State Canvassers by Friday.
The Michigan Constitution would be amended to state that there is a fundamental right to reproductive freedom.
The measure bars the state from punishing people for performing an abortion, but it does allow the procedure to be restricted after the fetus is viable.
Michigan's Board of State Canvassers deadlocked in a 2-2 vote on whether to approve the amendment last week, which stopped the measure from being on the ballot.
The board's Republican members rejected the ballot measure because of the formatting errors, even though the board's Democratic members argued they didn't.
The board didn't have the power to reject the proposal since it had enough signatures to make the ballot.
The board members who rejected the ballot measure would not disenfranchise millions of Michiganders not because they believe the many thousands of Michiganders who signed the proposal were confused by it, but because they think they have identified a technicality that allows them to do so. It was a sad marker of the time.
The group behind the petition to add an extra "the" was asked by the board to add spaces between words. According to an analysis by Bridge Michigan, those spaces do exist, but are hard to see due to the way it was formatted.
More than one million. There was a record number of signatures on the petition to put the abortion rights initiative on the ballot. According to the Associated Press, only 596,379 were approved by the state Bureau of Elections, but that is still higher than the number of signatures needed.
In Michigan, what will happen with abortion rights? The 1931 abortion ban that would outlaw the procedure in the state will be nullified if the ballot measure passes. The Michigan Court of Claims struck down the law as unconstitutional on Wednesday, but the case is likely to be appealed, meaning it's still possible for a court to reverse the law if the ballot measure fails. The Republican-controlled legislature could pass new abortion restrictions if the governor is not reelected and can't veto them.
Five states have ballot measures related to abortion rights. Kentucky has an amendment on the ballot that will not protect abortion rights if it is approved. Montana wants to grant legal rights to infants who are born alive, including those who have been aborted. It was the first time voters weighed in on abortion rights after the Supreme Court overturned Wade. According to the Washington Post, the vote in favor of reproductive rights there has made abortion rights advocates look to ballot measures as an attractive way to shore up abortion rights in GOP-controlled states. In states such as Arizona, Ohio, Pennsylvania, North Dakota and South Dakota, pro- and anti- abortion rights advocates are working on initiatives that could be put to a vote in the next two decades.
