The Justice Department asked the court to block the special master from getting classified materials as a result of the ruling.
Cannon's ruling bars the DOJ from reviewing classified materials as part of its investigation and requires it to turn over those classified documents to a special master, but the DOJ filed a notice saying it would appeal the ruling.
Cannon ruled Monday that a special master should be appointed in the case after Trump asked her to do so and the DOJ protested that a special master was not necessary.
The DOJ took more than 11,000 materials from Mar-A-Lago in August and the special master would review them to see if they were covered by attorney-client privilege.
Cannon's order is only applicable to classified documents and not to the appointment of a special master.
Cannon shot down the government's argument that a special master was unnecessary because the documents seized belong to the National Archives and not to Trump, and that the DOJ had already reviewed all the documents and identified materials covered by attorney-client privilege.
She disagreed with the DOJ's argument that Trump cannot shield materials under executive privilege from the actual, and she ruled that some of the materials belonged to Trump.
Cannon's order and the judge's reasoning to the New York Times were widely criticized by legal experts.
A list of potential special master candidates will be presented to the district court by Trump's attorneys and the Justice Department on Friday. The DOJ hasn't filed a formal appeal with the 11th Circuit, and it's not clear what the exact scope of that appeal will be, or whether it will only be focused on classified documents.
The investigation will be affected by the court battle. Even if the government gets an appeals court to rule in their favor, the court proceedings will still likely draw out the investigation because of the Justice Department's argument that the special master's review will impede its investigation. Legal experts don't think Trump has the power to shield documents from the White House, so courts will have to decide. It is unclear how long it will take for the appeals court to rule on the case and the possibility that it could go to the Supreme Court.
Two weeks after the FBI searched Mar-A-Lago, Trump asked Cannon to appoint a special master who would look into the matter. The Justice Department is looking into whether Trump violated three federal statutes, including the Espionage Act, by failing to turn over all the documents he had on hand. It was unclear whether the DOJ would appeal Cannon's ruling in the case, and legal experts speculated to the Times that the government could just accept a special master. The DOJ should appeal the case to make sure that Cannon's ruling is not seen as flawed.
The judge gave the special master to review the documents.
Experts question the judge's intervention in the inquiry.
