The Chancellor wrote in the court filing that she was not convinced that a four week delay would be worth it. She says that employee departures and the difficulty of continuing operations are what caused the deal to fall apart.
In July of this year, Musk's team was refused permission to push the trial to February of next year, as well as five days in October of this year.
The ruling isn't all bad news for the richest man in the world. Peiter "Mudge" Zatko's complaint was allowed to be included in the case after the request for a delay.
The Washington Post, CNN, and lawmakers were the recipients of a lengthy document from Zatko. Zatko claimed that the social media company had many security flaws. Adding fuel to the fire of Musk's constant bot data demands, he included allegations that the platform knowingly opts to forgo accurate accounting of bots on the platform.
The ex-exec was subpoenaed to testify after blowing the whistle. Zatko said that he will comply with both subpoenas, though his lawyers denied that he filed the initial disclosure for Musk.
Mr. Zatko's appearance at the deposition is voluntary because of his legal obligations. The legal team for the whistle blower said that he did not make his disclosures to the appropriate governmental bodies to benefit Musk, but to protect the American public.
As a condition of allowing Zatko's complaint to be added into the defense case, McCormick decided to limit the investigation to only the whistle blower allegations. The filing was from the court.
Defendants are permitted only incremental discovery relevant to the new allegations. That discovery can be made through targeted document discovery and minimal additional experts and fact witnesses. The parties are ordered to confer immediately to attempt to negotiate reasonable parameters for the additional discovery
The Chancellor disagreed with the idea that the new material would be useless. The world will have to wait for the post- trial decision on whether or not the whistle blower document changes anything for Musk.
