A Delaware judge ruled Wednesday that Musk can include claims made by Zatko in his countersuit justifying his withdrawal from his deal to buy the social media company.

The world will have to wait for the post- trial decision after the approval was largely expected.

Musk's case should be strengthened by including Zatko's complaint, which supported some of Musk's concerns, but he was denied his request to push the trial back.

The trial will start on October 17th.

Alex Spiro, one of Musk's lawyers, said in a statement to Forbes that they were hopeful that winning the motion to amend would lead to the truth coming out in the courtroom.

The company looks forward to presenting its case in court on October 17th and intend to close the transaction on the price and terms agreed upon with Mr. Musk, according to an email from a company spokesman.

Even a four week delay would risk further harm to the site, according to the order.

The Delaware Court of Chancery is where the lawsuit was filed, looking to force the deal through. Zatko accused the company of committing numerous "egregious" security violations, as well as pursuing a policy of "deliberateIgnorance" in tracking bot on the site.
