The judge in New Mexico ruled that the Otero County Commissioner and founder of "Cowboys for Trump" must be removed from office for taking part in the Capitol riot.

Judge Francis Matthew ruled that he will be ousted from his position as county commissioner immediately because he is barred for life from holding any federal or state office.

The judge concluded that he was constitutionally disqualified from those positions.

The transfer of power to President Joe Biden was disrupted by a mob of former President Donald Trump's supporters. There was a conviction for breaching Capitol grounds in January.

Matthew wrote in the ruling that the riots constituted an "insurrection" under the 14th amendment to the constitution.

It was the first time that a court found that the Capitol riot was an insurrection, according to the nonprofit government watchdog group.

Any public official who took an oath to defend the U.S. Constitution and then participated in the January 6th insurrection will be removed and barred from government service.

The last time a court disqualified a public official under the 14th Amendment was in 1869.

The Disqualification Clause bars anyone from holding civil or military office in the United States if they have engaged in insurrection or rebellion against the same.

Matthew ruled that Griffin's actions aided the insurrection, even though he didn't enter the Capitol or commit violence.

The judge said that by joining the mob and being on restricted Capitol grounds, Mr. Griffin contributed to the delay in the election certification proceedings. Matthew ruled that the presence of the man contributed to law enforcement being overwhelmed and that he encouraged the violence during the riots.

The judge dismissed the arguments made by the man who represented himself in the case.

The Capitol riot took place two weeks ago. He was sentenced on June 17 to two weeks in jail and a $3,000 fine after being convicted in March.

Trump has echoed his false claims that the 2020 election results were compromised by widespread fraud.

The Otero County Commission refused to certify the results of the most recent primary election because of conspiracy theories about the voting machines. The commission voted in favor of certifying the primary results, but still no one was able to get a majority.

Cowboys for Trump is a group that puts on pro- Trump parades.

The January 6th insurrection and the attempts to disrupt the peaceful transfer of power in the United States were the subject of Tuesday's ruling.
