According to a report by The Jerusalem Post, United Airlines is being sued for fraud, breach of contract, and negligent conduct. We will look at the lawsuit after covering the basics of the flight.
There is an incident involving a United Airlines flight from Newark to Tel Aviv. The plane was supposed to leave at 4:25PM. The flight would be delayed by over 12 hours, and passengers were told shortly before departure that the flight would leave early the next day.
The reason this flight got a lot of attention was because of the reasoning United gave for it. The flight was delayed because of a curfew, according to United Airlines. Ben Gurion Airport in Israel doesn't have a curfew and many passengers took issue with that.
The reason for the delay was because the crew was not ready to leave.
The delay was due to a maintenance issue according to United. The passenger said that the delay was due to bad weather.
There were rockets fired into the Tel Aviv area during the most recent fighting in the Gaza Strip.
The passenger of this flight from Newark to Tel Aviv filed a lawsuit against United Airlines over the delayed flight. The airline is being sued for $50,000 with interest and legal fees as United is being accused of a lot of things. The summons says so.
“[United] committed fraud and deceit against Plaintiff and all other passengers when its crew refused to perform their job, and United deliberately, and knowingly lied about the reason for its delay.”
A separate flight on El Al was booked by the person in this case. The passenger's checked bags would be put on a United flight to Tel Aviv. Travelers were offered a $40 meal voucher, but United gave little support to passengers.
Some passengers claimed that United denied them accommodations, but the airline said that hotels were provided to passengers.
This incident seems like a flight delay to me. Airlines are terrible at giving accurate information. Airlines love to default to weather as the reason for delays, as that's something that can't be controlled, and gets them off the hook.
There are four different reasons why the flight is delayed. The curfew reason was questionable. It's absolutely true. I don't know if I would attribute that to malice or stupidity.
If the pilots said they weren't comfortable flying to Tel Aviv while there were rockets being fired, the person responsible for updating flight status listed a "curfew" as the reason for the delay.
Airlines don't make any promises about when they'll get you to a destination and contracts are notoriously one-sided. There was a valid reason for the delay, even if it was within the carrier's control.
If the pilots refused to fly in light of rockets near Tel Aviv, the airline had to find new pilots and possibly no reserve pilots available.
It seems like a bit of a stretch to file a $50K lawsuit over a flight delay, but I'm not a lawyer with time on my hands, so...
The United Airlines is facing a lawsuit. Passengers were given a variety of reasons for the delay, from a non-existent curfew, to the pilots refusing to fly, to weather, to maintenance. In the airline industry, that is very common.
The passenger has filed a $50,000 lawsuit against the airline. I can empathise with how poorly and inaccurately airlines communicate delays, but I don't think this qualifies for such large monetary damages.
