Pfizer and BioNTech are accused of copying Moderna's "groundbreaking technology" critical to the development of their Covid vaccine.

Moderna didn't want to remove Comirnaty from the market or ask for an injunction to block future sales to make sure continued access to these vaccines.

The company will not seek damages for vaccine sales in low- and middle-income areas, as Moderna began to enforce its patents again after suspending enforcement in October 2020.

The company's chief executive said in a statement that Moderna filed the lawsuit to protect the innovative mRNA technology platform itpioneered, invested billions of dollars in creating, and patented during the decade preceding the COVID-19 Pandemic.

Moderna shares have struggled this year as Covid rates have waned and demand for vaccines has gone down.

Pfizer told Forbes that it was surprised by the litigation and will fight against the allegations.
