NBC News and NBC New York reported Wednesday that Harvey Weinstein was granted an appeal of his 2020 conviction of rape and other sexual crimes.
A court spokesman told NBC that the Chief Judge of the New York Court of Appeals granted Weinstein a leave of absence after he was sentenced.
oral arguments are expected to be held next year, if a new trial is ordered or if Weinstein's conviction is thrown out.
According to the New York Law Journal, the opportunity for the appeal was granted because there are questions of law that should be further reviewed by the court of appeals.
Weinstein had argued that testimony from women who were not victims should not have been allowed.
Weinstein did not receive a fair trial and his conviction should be reversed, according to his lawyer.
He has pleaded not guilty to rape and sexual assault charges in Los Angeles.
The uncovering of widespread sexual abuse allegations against Weinstein led to the #MeToo movement and brought similar claims against powerful figures in nearly every industry. Over 80 people have accused Weinstein. In the 2020 trial in New York, Weinstein was found guilty of one count of third degree rape and two charges of commuting a sexual act in the first degree. His conviction was upheld in June.
The Pennsylvania Supreme Court overturned Bill Cosby's conviction last year after he was accused of sexually abusing dozens of women. The district attorney had to follow his predecessor's agreement to not charge Cosby when he gave potentially incriminating statements against himself.
