The Justice Department's Capitol riot probe is the most dangerous legal threat to the former president, according to his one-time White House counsel.

The most serious case he faces is the January 6 investigation, according to Ty Cobb, who served as White House special counsel in the last two years. The interference in Georgia, Arizona, Pennsylvania, and other states is linked to the fake electors scheme and January 6 alone.

He said that the case was more at the heart of what the Justice Department would take seriously.

The DOJ is investigating the attack on the Capitol. The events that led to the failed insurrection, as well as any attempts to obstruct the inquiry, are being investigated by investigators.

When he worked with Trump, Cobb said the former president listened to and agreed with his advice.

It's hard to tell if his lawyers are following his advice or if he's following his own.

Trump called the January 6 attack a simple protest that got out of hand. The Justice Department went on a fishing expedition against his supporters.

The former president's attention has shifted recently to the investigation into his handling of government records. The FBI took the extraordinary step of executing a search warrant at Mar-a-Lago earlier this month where agents recovered more than a dozen boxes, some of which contained classified and top- secret material that Trump moved from the White House.

The National Archives and the Justice Department had been trying to get Trump to give them the records. According to the FBI's search warrant, the feds are looking into whether Trump broke three US laws when he took the records to his private residence in Florida.

The most direct and immediate threat to the former president is the Department of Justice's investigation into Trump's handling of the documents, according to a former federal prosecutor.

The blowback from Trump and his allies is likely to have been anticipated by Attorney General Garland and other DOJ and FBI officials.

If they thought the public would view the raid as being completely defensible once the facts came out, they would open themselves up to it.

The department's Capitol riot probe is more complex, but he thinks it will be a clean case.

"It would take two years to prepare that case and months to present it, so I'm not saying it couldn't be done or it shouldn't be done," he said. There would be a lot of legal issues.

The DOJ's criminal investigations into the Capitol riot and Trump's handling of government records are just some of the legal threats facing the former president.

In Georgia, the Fulton County district attorney's office is looking into whether Trump and his allies broke the law in their attempt to overturn Biden's victory. In New York, the Manhattan district attorney's office secured a plea deal with Allen Weisselberg, who last week pleaded guilty to more than a dozen felonies.

A lawyer for the Trump team told Insider last week that the president should be concerned about the investigations. I think he's going to be indicted by all of them.

The former president's legal team filed a motion Monday requesting that a special master be appointed to review evidence that the FBI seized from Mar-a-Lago.

The Justice Department might be in favor of appointing a special master, according to the man.

The investigation of a former president is unprecedented. I would want to play it by the law because this has never happened before.
