  • FBI agents raided Trump's Mar-a-Lago home.

  • The DOJ does not take certain steps in 90 days before an election.

  • In July, a memo from Garland reiterates high-level approval from DOJ officials.

The FBI raided Donald Trump's Palm Beach resort home just before the deadline.

The Department of Justice standard of not taking overt investigative steps that could be perceived as politically motivated within 90 days of an election appears to have been followed.

The decision to execute the raid on August 8 is most likely due to the upcoming elections, according to a former federal and state prosecutors.

Konig told CNN that today is about 90 days out from the elections. If they're interpreting that as a 90 day rule, that may be a reason why they did it today.

The Justice Department policy requiring high-level approval of politically sensitive investigations was reiterated in a May memo.

The memo reminded the DOJ of its longstanding policy of avoiding steps that could be perceived as partisan and designed to influence an election result.

The new requirement that the Justice Department leader approve any investigations into presidential candidates was added to the policy in February 2020.

In an election year, this is important. "Now that the election season is upon us, and as in previous election cycles, I am issuing this memo to remind you of the department's existing policies with respect to political activities."

As Trump weighed an early announcement of a third White House run and concerns that Garland's Justice Department would stall, the memo set off a backlash on social media.

Fears were allayed Monday.

The Mar-a-Lago raid came within the 90-day window from the elections, but that won't stop some people from calling it a political raid.

The timing before the election appears to be a very strategic move according to an attorney and owner of a law office. Politics is not nice. This is the first time in the history of the US that an ex-president has been subjected to FBI raids.
