In light of the FBI raiding his Mar-A-Lago estate on Monday, Donald Trump decided to invoke the Fifth Amendment and refuse to answer any questions during his deposition in the New York attorney general's investigation.

As part of the civil investigation into the Trump Organization and its financial dealings, Trump was scheduled to testify on Wednesday.

In a statement posted to his social network Truth Social, Trump said he "declined to answer the questions" under the advice of his legal counsel, as well as because he believes the investigation is a "vindictive and self-serving fishing expedition"

The ex-president pointed to the FBI's raid on his home Mar-A-Lago on Monday, which was unrelated to the New York investigation and the Trump Organization, and said that "wiped out any uncertainty" about him answering questions.

NBC News reported that neither of Trump's children pleaded the Fifth Amendment when they testified.

A request for comment has not been responded to.

I once asked why you were taking the Fifth Amendment. Trump said that he knows the answer to the question. You have no choice when your family, your company, and all the people in your circle are targets of a politically motivated witch hunt.

Legal experts told Forbes in January that probes like this can go on for a long time. As a civil investigation, James could bring a civil lawsuit against the company, Trump or any of his associates in court. If the court finds the company guilty of fraud, it could result in monetary damages, as well as the revocation of the Trump Organization's certificate.

The deposition of Trump and his children was supposed to take place in July but was delayed due to the death of his ex- wife. The Trumps had asked the court to block the subpoenas because they believed any information they gave could be used against them as part of James' separate criminal probe into the Trump Organization. They were told by the judge that they could refuse to answer questions under the Fifth Amendment if they didn't want to incriminate themselves. James expanded his investigation into the Trump Organization in May of 2021. The AG alleged in April that the company used fraudulent asset valuations and other misrepresentations to secure loans and tax deductions that were more favorable than the true facts deserved.
