According to multiple outlets, a judge in Georgia ruled Tuesday that Rudy Giuliani must appear next week before a special grand jury that is investigating Trump and his associates' attempts to overturn the 2020 presidential election results.
Fulton County Superior Court Judge Robert McBurney denied Giuliani's request to delay his appearance before the grand jury, which was launched by the Fulton County District Attorney to investigate Trump's post- election conduct.
Giuliani was supposed to testify before the grand jury Tuesday, but his attorneys argued that he couldn't travel by plane after his heart surgery.
The new appearance date of August 17 gave Giuliani plenty of time to get to Atlanta by car, according to McBurney.
A month ago, a New York Supreme Court judge ordered Giuliani to testify for the jury.
Giuliani is under investigation for spreading false claims of voter fraud to state lawmakers in the wake of the 2020 presidential election and urging them to appoint a new slate of electors in Trump's favor. The claims were made to legislators in several states. Giuliani tried to prevent the grand jury from subpoenaing him to testify. He didn't show up for the hearing about the challenge. A separate grand jury would need to indict Trump or anyone else involved in order for a report to be issued by the special grand jury. The House January 6 committee aired clips of Giuliani appearing before Georgia lawmakers and promoting false theories that Trump actually won the state of Georgia.
The jury has subpoenaed several other Trump allies.
