According to two people familiar with the move, Senate Majority Leader Chuck Schumer wants to make sure Senate Republicans don't remove the $35 monthly cap oninsulin prices from the big bill under consideration.

One of the most popular parts of the legislation that Democrats want to pass is the $35 limit on co-pays for diabetes care. Senate Democrats can sidestep GOP resistance and approve certain bills if they all stay united.

Since it may not comply with its strict procedural rules, the cap may fall out of the bill. The Senate parliamentarian gave the go-ahead to most of the Democratic legislation's provisions overnight.

The fate of the cap is not yet decided. The top official didn't believe it complied with reconciliation's rules because the parliamentarian sustained a GOP objection to it.

There is a $35 cap in the Inflation Reduction Act. Senate Democrats can force Republicans to take it out if the parliamentarian strikes it out. A recorded vote would be needed to overrule the parliamentarian.

Susan Collins, who has worked with Democrats in the past on drug pricing, said she was waiting to see the final language before making a decision. Her vote is needed to get past the 60 vote threshold.

Collins doesn't know what language has survived or hasn't. I'm going to wait and see what the parliamentarian decides.
