Jones' lawyer asked the Texas state court judge to declare a mis trial over the text messages and to destroy any copies of them.

Mark Bankston argued that the request was a fig leaf to put over his own malpractice and that he was breaching his duty to his client.

Gamble questioned whether the request was serious or if it was a throw away ask, noting that the attorney had requested a mis trial 17 times.

The judge ordered the destruction of any messages containing medical information that were sent to opposing counsel, even though she refused to withdraw the documents that were sent to opposing counsel.

According to Bankston, the House January 6 Committee wants the attorney to turn over the cell phone records of Jones and other far-right figures. During their public hearings, the committee has shown footage of Jones and subpoenaed him, as they alleged that he helped organize the rally that preceded the January 6 attack. Even if she did allow Bankston to return the documents to him, it wouldn't stop the committee from issuing a subpoena for them.
