A federal judge on Tuesday rejected Donald Trump's request to toss three civil lawsuits in which Capitol police officers accuse the former president of being responsible for injuries they suffered during the January 6, 2021, attack.
Trump's lawyers argued that he was immune from civil litigation related to the Capitol riot because he was in the outer perimeter of his presidency.
The US District Judge refused to dismiss the lawsuits on those grounds, noting that he had previously rejected a nearly identical assertion of absolute immunity that Trump raised in response to other civil lawsuits filed by House Democrats.
The court already rejected President Trump's assertion of immunity in the case of Blassingame v. Trump.
Mehta said that the court does it again. The court does not repeat its reasoning here, but simply adopts and incorporates it by reference, specifically that Trump's actions on January 6 did not fall within the outer perimeter.
President Trump's motions to dismiss were denied.
Trump asked a federal appeals court in Washington, DC, to grant him immunity from civil lawsuits accusing him of inciting the Capitol storming. In a 48-page filing, Trump's lawyers said that Mehta had allowed the civil lawsuits to proceed against the former president out of a dislike for Trump's speech on January 6.
If the presidential act in question is unpopular among the judiciary, the immunity given to the former president can't be cut.
