The aiding and abetting DWI charge against Paolo was dropped after Michael Savarino, Paolo's former Duke teammate, pleaded guilty to the crime.
It's not unusual for a person charged with aiding and abetting drunken driving to have their charge dismissed, according to the assistant district attorney in Orange County.
Savarino pleaded guilty to driving after consuming alcohol while under the age of 21 and running a stop sign, but the charges were dropped.
He has to complete a treatment program as part of his plea agreement. He did 24 hours of community service and paid a fine.
The two men were arrested in November after a traffic stop. Savarino was charged because the vehicle he was in was registered to him.
The BlueDevils learned from the incident and had moved on. After one season at Duke, Banchero went to the NBA draft and was selected by the Magic in the first round.
During the off-season, Savarino moved to New York University.
