In a letter to the Delaware Chancery Court, Musk's lawyers said that they should be forced to do so because of the way the case is being handled. The letter, which you can read in full below, was sent to the Chancellor and requested that the trial should begin on October 17th.

The trial will begin in October. The company had argued that the shenanigans are hurting the company and that things should be resolved as soon as possible. It is expected that Musk will pay $54.20 a share to buy the company. The team for Musk asked for a longer time frame to begin the trial. The two sides were told to start preparing.

Team Musk says it tried to begin the discovery process, but was repeatedly stopped by the social media platform. The lawyers wrote in the letter that the defendants' efforts to make sure the case is trial ready by October have not been reciprocated by the social networking site. Musk wants to get out of the deal so that he can prove that there is a problem with the service. That isn't what this case is about. It is about whether or not Musk is required to honor the contract to buy the social networking site.

“Defendants’ efforts to make sure this case is trial-ready by October, have not been reciprocated by Twitter, who at every turn has sought to delay.”

Three main issues holding up the process were cited by Musk's lawyers. The letter says that the lack of a specific trial date is allowing the service to be delayed. Musk wants the trial to start a week later so that he has more time to prepare. The documents that are easy to produce are not being produced by Musk. According to Musk's team, they need more of the firehose data by August 1st. The letter is asking for information on Musk's timeline.

A trial that has become a game of back-and-forth legal filings will surely respond soon enough. It has said in the past that Musk's data requests are ridiculous and irrelevant to the case at hand and continues to argue that every minute this saga lasts is damaging to the company. Musk was accused of being just as obfuscating and helpful.

There will be a lot more complaining in legalese in the next few weeks as both sides try to get an upper hand in the court battle. The most interesting thing to watch is how McCormick decides to involve herself here, she is in charge, and how she sees the fight unfolding.
