Kinzinger told reporters that the committee wouldn't be able to prosecute Trump so he couldn't make a prosecutorial judgement. The Justice Department can be informed of criminal conduct by its members.

Kinzinger said that Trump has criminal exposure.

"If you look at what we presented tonight, and then all these hearings, that cannot be accepted from the president of the United States," he said.

According to former Justice Department officials, there is enough evidence to prosecute a former president.

It was easier for the FBI to identify and charge those who boasted of their involvement. More than 800 people have been charged in connection with the insurrection.
