Graham still had the right to challenge the legality of the subpoena.

The lawmaker asked a federal judge in South Carolina to quash the subpoena issued by the Fulton County, Georgia, District Attorney.
The judge should reject Graham's request due to the fact that a subpoena hadn't yet been issued to the senator in South Carolina.
Attorneys for both parties told the judge that they had reached an agreement to withdraw all process and proceedings pending before the South Carolina district court.
According to the court filing, Senator Graham has agreed to accept service of a subpoena for testimony from the Fulton County Special Purpose Grand Jury in Atlanta, Georgia.
Georgia will be the location of future challenges to the subpoena.
There was a scheduled hearing in the South Carolina court.
