A judge ruled on Tuesday that a trial will take place over the course of five days in October of 2022.
In a virtual hearing, a Delaware Chancery Court judge agreed to expedite the trial, arguing that the longer a merger transaction is in limbo, the more uncertain it is.
There was a question of whether the trial should be expedited or if Musk's team could receive a delay to conduct discovery in order to bolster his reasoning for withdrawing his bid.
Andrew Rossman, Musk's lawyer, argued that once again the company refused to offer, and that Musk was banking on a justice "delay" becoming "justice denied"
The lawyer for the social media company argued that the calculation of the number of fake accounts was irrelevant to the case because Musk didn't include them in his acquisition agreement.
The public dispute has hurt the company's reputation and left it in limbo.
Rossman noted that Musk is the second largest shareholder in the company.
Rossman argued that the proposed September trial schedule was unjustifiable and that the company never received an answer other than obfuscation, generalities and excuses.
Musk wants to conjure an exit ramp for a deal that doesn't have one.

Two weeks ago, Musk said he was "terminating" his offer to buy Twitter for $44 billion, saying he believed the company had underestimated the amount of fake accounts. The CEO argued that there wasn't enough data to support the numbers. The lawsuit was filed in order to force Musk to fulfill the deal. According to the social media platform, Musk was using the bot argument as an out for a deal he no longer wanted to complete. After Musk's attorneys asked to delay the trial, the social media company hit back, arguing that the billionaire was trying to "disparage" and prolong the litigation.
Musk's bid to delay the trial fails at every level, according to the social network.
The Washington Post reported that in the first hearing, the social media company pushed for a quick trial against Musk.
