Musk accused the social media company of trying to rush its lawsuit against him after months of not giving him user data he requested.
The lawsuit was filed against Musk after he backed out of the deal. The lawsuit argues that the agreement Musk signed was binding and that he's only now backing out because it doesn't serve his interests.
Musk argued in his letter that the company failed to comply with its contractual obligations.
"For nearly two months, Mr. Musk has sought the data and information needed to make an independent assessment of the prevalence of fake or spam accounts on the platform," the letter said.
According to the court filing, the case was more complicated than the company had made it out to be and would need more time to play out.
According to the filing obtained by The Washington Post, the sudden request for warp speed after two months of foot-dragging and obfuscation is its latest tactic to shroud the truth about the accounts.
There is a dispute over false and fake accounts that is fundamental to the value of the company. It requires a lot of time for discovery and is very fact intensive.
In May, it was said that Musk was "flabbergast to learn how meager the process was for estimating the number of accounts" Musk said their process involved a random sample of only 100 accounts per day. It's all done." There was no automation, no artificial intelligence, and no machine learning.
The acquisition was threatened for months due to Musk's concern over bot accounts on the social networking site. The company accepted Musk's offer in late April after initially rejecting it. Musk said the deal was on hold while he looked into the matter.
In June, lawyers for Musk filed a complaint with the SEC accusing the social network of "actively resisting and obstructing his information rights" by not providing him with the data he wanted. Lawyers for Musk sent a letter to the SEC saying he was backing out.
The merger agreement will be enforced by the social media company. In its lawsuit filed against Musk on July 12th, the company said he was "refusing to honor his obligations" and that he had no merit in his accusations.
The lawsuit said that Musk's "antics" and the "disdain he has shown" for the company put it at risk.
Shortly after the lawsuit was filed, Musk sent a brief statement on the matter.
On Friday, Musk's first formal response was filed. It wants the trial date to be set after February 13, 2023, so that they can evaluate the amount of bot on the platform.
Lawyers for Musk did not respond to Insider's questions.
