Heard's lawyers filed a request for a new trial on Friday, claiming that a juror that was not called for duty participated in the trial and that her right to a jury trial and due process was compromised.

According to Heard's lawyers, a mistrial should be declared because juror No. 15 was not summoned for jury duty.

There are two people with the same name who live at the same address in Virginia.

The person born in 1945 was summoned for jury duty in April but the person born in 1970 didn't show up for jury duty.

According to the filing, jurors need to fill out a questionnaire to make sure they are who they say they are.

It is troubling for an individual not summoned for jury duty yet to appear for jury duty and serve on a jury in a high-profile case where the fact and date of the jury trial were highly publicized before and after.

The jury ordered Heard to pay over $10 million in damages for defaming him.

Forbes reached out to the two people.

Heard's lawyer said that the person who appeared for jury duty with this name was the younger one.

Key Background

The lawsuit was filed after Heard wrote for the Washington Post that she was a public figure representing domestic abuse. During a six-week televised trial, Heard claimed that she was physically and emotionally abused by her husband. The actor said Heard's claims cost him his career. The statements made by Heard and the statement made by her lawyer were found to be defamation. Heard's lawyer has said that she can't afford to pay the damages. After the verdict, Heard's lawyer said she would appeal. Heard's team asked for the verdict and damages to be thrown out on several grounds, including that juror No. 15 was not properly vetting, because of their birth date discrepancy. The juror's identity could not have been verified according to the motion.

The jury said thatAmber Heard didn't come across as believable.

The trial wasn't fair, says amber Heard, but she doesn't blame the jurors.

A lawyer for the actress says she can't pay a $10 million judgement.
