A New Philadelphia man will be sentenced to at least eight years in prison for having sex with a young girl.
Tuscarawas County Common Pleas Judge Michael Ernest said at the sentencing hearing that alcohol was used in the commission of the crimes, but that McNutt did not use or threaten force. McNutt met the victim on the internet.
McNutt's prison sentence can be extended by up to four years by the Adult Parole authority.
The 19-year-old pleaded guilty to two rape charges.
McNutt was found guilty of two counts of rape and one count of gross sexual imposition.
The victim may have harmed herself after the crimes came to the attention of law enforcement.
McNutt apologized in court.
After he is released from prison, he will be on parole for five years. He will have to register his address with the sheriff every 90 days for the rest of his life.
He was given credit for the time he spent in the jail.
McNutt was ordered not to have any contact with the victim while he was in prison.
Penalties for rape ranged from 3 to 11 years in prison and a fine.
The sentence was recommended by the assistant prosecutor.
The possibility of a life sentence was eliminated as a result of the amended rape charges. The victim was younger than 13 when the charges were originally made. She was accused of being 13 or older.
McNutt's defense attorney asked the judge to sentence him on the low end of the range because of his age and disabilities. She didn't say what the disabilty was, but she did say that the background reports contained information about counseling for sex offenders.
McNutt has no criminal record.
Ernest told him that the decisions he had made wrecked his life, his family's life and his victim.
"You're going to have to accept what you've done here as being wholly inappropriate and wrong, and from then, move on," he said. You're a young man, right?

The victim didn't show up. Krista said the victim's mother agreed with the amendment that resulted in the prosecutor's recommendation of eight to 12 years in prison.
