The Supreme Court may soon give state legislatures total control over their states' elections, and make it much easier for them to overturn the results.

The court will hear the case of Moore v.Harper, a dispute brought by Republican lawmakers in North Carolina after state courts rejected the map they drew up for being too skewed toward the GOP.

The lawmakers asked the court to consider the "independent state legislature" theory and whether state courts are allowed to overrule state legislatures on voting-related matters or if that violates the Constitution, which states the "time, place and manner" of holding federal elections "Shall be prescribed in each State

If the theory is upheld by the justices, it will allow state lawmakers to impose voting rules they want for federal elections and take away the power of state courts or secretaries of state to impose voting rules themselves.

The theory was used by Donald Trump and his allies in post- election lawsuits to argue that the election was unfair and should be left to the states.

During the 2020 election, a judge in Wisconsin ruled that the legal argument was contrary to the plain meaning of the Constitution.

It would be easier for campaigns to use that argument in future elections if the Supreme Court upheld the theory.
