The Supreme Court is set to release its last two rulings of the current term on Thursday, and Justice Stephen Breyer told the president that he will retire at noon that day.
The justice said in January that he would leave at the end of his term. Thursday is the last day for opinions to be released.
A judge on the U.S. Court of Appeals for the District of Columbia Circuit will replace him. The Senate confirmed her nomination to the Supreme Court in April of this year.
In a letter to Biden dated Wednesday, Breyer said he was honored to be a judge in the effort to maintain the Constitution.

Six days after the Supreme Court ruled that there was a federal right to abortion, Justice Stephen Breyer will leave the court.
He was one of two liberals who dissented to Friday's decision, which gave individual states wide latitude in banning abortion.
Last week, Breyer wrote a pointed dissent to a ruling by the court's supermajority of six justices, which struck down a New York state law requiring applicants for a license to carry a gun outside of their homes to have "proper cause" to do so.
Many States have tried to address some of the dangers of gun violence by passing laws that limit who can purchase, carry, or use firearms. The court burdens states with their efforts to do so.
