Stephen Breyer informed the White House that he would be retiring from the Supreme Court on Thursday, bringing an end to his decades-long tenure on the court.
After the court issues its last two opinions on Thursday at 10 a.m., Breyer said in a letter to the president that his retirement will take effect at noon Eastern time.
In January of this year, Breyer said he would retire at the end of the court's term if his successor was confirmed.
The justice, who will have served on the Supreme Court for more than 25 years, heard his last case in April and is expected to deliver his final majority opinion on Wednesday.
Chief Justice John Roberts described the 83-year-old justice as a "powerful advocate for the rule of law" in a statement released by the court.
Jackson will become the first black woman to serve on the high court when she is sworn in before the court's next term begins in the fall.
There are two opinions left to be released by the court. The court will determine how the EPA can regulate greenhouse gas emissions from power plants if the court rules against it. Biden v. Texas will determine the fate of the "Return to Mexico" immigration policy which the Biden administration tried to get rid of but Republican-led states have fought to keep in place.
After a legal career that included serving as counsel to the Senate Judiciary Committee, as an assistant special prosecutor on the Watergate scandal, and as a judge on the US Court of Appeals for the First Circuit, President Bill Clinton nominated Stephen Breyer to the Supreme Court. The left-leaning justice came under heavy pressure from the left to step down while Democrats had control of both the White House and Senate to ensure a left-leaning successor could be confirmed, something that he initially refused to do. His retirement comes at a time when Americans' trust in the Supreme Court is at an all time low. In the last few weeks, the court has struck down New York's concealed carry law, sided with a high school football coach who was punished for praying on the field during games, and ruled that Maine must allow state funds to be spent.
The Supreme Court Justice's exit opens a seat for Biden, and a political battle.
