Louisiana state Judge Robin M. Giarusso signed a temporary restraining order blocking the state's new abortion laws while the abortion providers' challenge is heard.

If Giarusso grants the abortion providers' request for a preliminary injunction, the laws will be blocked or put back in place.

The state of Louisiana has an abortion ban that abortion providers and advocates argue is vague.

One of the abortiontrigger bans only applies to abortions after 15 weeks, but the others ban all abortions, and it is not clear which ones have taken effect.

A request for comment on that state's lawsuit has not been replied to.

Utah has an abortion ban that took effect on Friday after the U.S. Supreme Court ruled in favor of abortion rights. While the U.S. Supreme Court said states can ban abortion under federal law, the lawsuit argues that the Utah law is unconstitutional. The Utah AG told the Salt Lake Tribune that his office would defend the state law.

Louisiana voters approved a ballot measure in 2020 that added the statement to the state's constitution that "nothing in this constitution shall be construed to secure or protect a right to abortion or require the funding of abortion." The Guttmacher Institute says that Louisiana is one of four states that do not protect abortion rights.

State lawsuits against abortion laws. Louisiana and Utah are two of 13 states withtrigger bans that either have already banned abortion or soon will, along with states that had abortion bans that were previously blocked but were allowed to take effect after the Supreme court's ruling. The six-week abortion ban that took effect in Ohio is likely to be challenged by abortion rights advocates.

What We Don’t Know

State courts might be able to make it easier to ban abortions. State supreme courts in Florida, Montana, Kansas, Alaska and Minnesota have upheld the right to the procedure in the past. In Iowa, where the state Supreme Court overruled its precedent in favor of abortion rights, Republicans are trying to challenge those precedents. The Florida Supreme Court is expected to soon weigh in on the state's 15-week abortion ban and has recently become more conservative, raising fears that the court will overturn its precedent. In August, voters in Kansas will be asked to decide if the state constitution should be amended to say that it doesn't protect abortion.
