A state judge rejected Sidney Powell's attempt to dismiss the State Bar of Texas' legal case against her, which accuses the lawyer of committing professional misconduct, which could result in her being disbarred.
The state bar confirmed to Forbes that the judge denied Powell's motion to dismiss the case.
The state bar's Committee for Lawyer Discipline filed a petition against Powell in state court in March, asking the court to sanction Powell and rule she committed professional misconduct with her lawsuits seeking to overturn the 2020 presidential election results.
Powell is accused of violating rules of professional conduct that prohibit attorneys from making false statements, using false evidence, bringing frivolous lawsuits, and taking a position that causes delays or burdens.
In her motion to dismiss the litigation, Powell claimed the committee's case against her was a "baseless and illegitimate suit" and that the legal action would make it much harder.
According to the Dallas Morning News, Bouressa denied Powell's request to throw out the case, but said she hadn't made a decision on the allegations against Powell.
Powell and her attorney did not respond to the request for comment.
According to the case's court docket, a trial is scheduled to start on October 17th. If Powell is found to have committed professional malfeasance, the state bar wants the court to impose an appropriate sanction on her. Powell could be disbarred and lose her law license to less serious consequences under the State Bar of Texas' rules.

In the aftermath of the 2020 election, Powell brought post- election lawsuits in Arizona, Michigan, Wisconsin and Georgia, which sought to overturn the results. Powell and her co-counsel were reprimanded by the judge in the Michigan case for bringing that lawsuit which the court ruled was about debasing the judicial process to do so. The FBI has opened a criminal investigation into Powell's group Defending the Republic, her attorney has confirmed, as she is facing multiple defamation lawsuits from voting machine companies. Powell has remained defiant and stood by her election fraud claims despite the mounting consequences against her and has resisted cooperating with the House January 6 Committee's investigation into the aftermath of the 2020 election.
The Washington Post notes that such a financial relationship could be in violation of ethics rules that prohibit getting outside funding for legal defenses without informed consent.
