New Mexico held its primaries last week for a governor's race and some local races, but the county commission voted against certifying the results, four days after they voted to demand a hand recount.

In an interview with Forbes, Commissioner Couy Griffin didn't offer any specific evidence of voter fraud during last week's primary, but members of the county commission have cited various concerns about the machines.

There is no evidence of widespread voting machine-based fraud, but the Secretary of State says the county is breaking state election law by refusing to certify results, demanding a recount, and threatening to clash with state voting machine.

The Otero County commission is going rogue because the county clerk doesn't have the authority to do a recount, according to Oliver's spokesman.

In a letter Thursday, Oliver asked the Attorney General's office to open a "prompt investigation" into Otero County.

Attorney General Balderas said in a statement that the commission must comply with the rule of law.

There is a chance of an investigation by the Attorney General's office. I won't be a stamp. My questions should be answered.

What To Watch For

The Otero County commission was ordered to certify the election by Friday by the New Mexico Supreme Court after Oliver sued them. It is not clear if the commission will abide by the court's ruling. When Forbes asked if he would change his vote, he said he wouldn't, but wouldn't be present for Friday's meeting because he was in D.C. The other two Commissioners didn't reply to questions.

Key Background

It might be the first time in recent years that local officials have refused to certify an election because of false election claims by Trump. After he lost the 2020 election, Trump and his allies often claimed voting machines were rigged to steal votes, a completely false theory that has seemingly been entertained by Otero County officials. GOP officials in Arizona have used their suspicions about voter fraud to conduct questionable audits of the 2020 results. The county commission requested an audit overseen partly by David andErin Clements, who have traveled the country to look at elections. According to the Alamogordo Daily News, a company hired to investigate the results said it found no election fraud, despite the fact that the audit was only partially completed. In March, the U.S. House Oversight Committee said it was investigating whether door-to-door canvass could intimidate voters.

According to Forbes, we are in new territory. The act is based on the election lies of 2020.
