Trump lawyer cited ‘heated fight’ among Supreme Court justices over election: report

According to a report in The New York Times, John Eastman, a lawyer and adviser to former President Trump, said in an email exchange shortly after the 2020 presidential election that four Supreme Court justices were in a "heated fight" over whether to take up a case.

Two people familiar with the emails told the outlet that the discussion between the Supreme Court justices and the Trump campaign was heated.

Eastman was exchanging emails with a pro-Trump lawyer.

The justices will become more favorable if they start to fear that there will be chaos on January 6.

Two of Trump's election fraud cases were rejected by the Supreme Court.

I shouldn't discount John's estimate because I don't have the personal insight that John has into the four justices likely to be most upset about what is happening in the various states.

If the justices start to fear that there will be chaos on January 6 then the odds of action before then will be more favorable. It could go against us on the merits, though. Rule against us would be the easiest way to calm the situation.

The wife of Supreme Court Justice Clarence Thomas received emails from Eastman. As a clerk, he worked for Justice Thomas.

The timing and content of the emails were not known.

The Washington Post reported on the existence of the emails between the two people.

Giving the justices a Wisconsin cert petition, one of the states Trump has claimed election fraud in, could help them in their discussions.

There is a heated fight going on and the odds are not based on legal merits, but on an assessment of the justices' spine, according to sources.

The Capitol riot committee is looking at the emails and texts between the two women.

Jamie Raskin, a member of the Jan. 6 House committee, said Thursday in an appearance on CNN that he could not yet explain why the committee has subpoenaed the woman.

Ginni Thomas encouraged electors in Arizona to vote against the results of the 2020 election.
