The day before the Capitol Riot, a lawyer for Mike Pence told him that Donald Trump's request to certify the election for him would fail in court, according to a memo.

Congress was in the process of certifying the 2020 presidential election when Trump supporters staged a protest.

According to a memo from Greg Jacob, an attorney for Trump, certifying the election in Trump's favor would violate the Electoral Count Act.

Jacob said in the memo that the move could fail in the courts or put America in a political crisis with no neutral arbiter available to break the stalemate.

The attorney will testify in front of the House committee this week, but his letter has been known to the committee for months.

Even though he didn't have enough electoral votes, Trump asked the vice president to certify the election for him. Multiple attempts were made to overturn election results.
