Lawyers for Alfred Garza, the father of Amerie Jo Garza, filed a petition asking for Daniel Defense to preserve evidence including marketing plans of its assault rifles, advertising, and social media campaigns.

Attorneys from Texas and Connecticut who previously sued the maker of the gun used in the Sandy Hook Elementary School massacre have been retained to represent Alfred.

The court was asked to force Daniel Defense officials to sit for a deposition and produce materials by a speech pathology clerk.

After his 18th birthday, Ramos legally purchased two assault-style rifles, but only brought one into the school.

Shortly after the shooting, Daniel Defense deleted its most recent post, which depicted a young boy holding a Daniel Defense firearm with the caption, "train up a child in the way he should go, and when he is old, he will not depart from it."

Daniel Defense did not immediately respond to a request for comment from Forbes, but a statement posted on its website said the company was sad about the tragic events in Texas and that it was praying for the families and community devastated by this evil act.

The company could be protected from liability due to the Protection of Lawful Commerce in Arms Act if a lawsuit were to be filed. The act was passed in 2005 after extensive lobbying from the National Rifle Association. President Joe Biden called for the repeal of the act in a speech on Thursday.

Key Background

Daniel Defense is one of the nation's largest privately held gun manufacturers, and CEO Marty Daniel told Forbes in 2017: "Consumer sales accounted for 90% of its total sales." When people see politicians talking about gun control, they become fearful and go out and buy guns. Daniel Defense pulled out of the convention because it was too soon after the Uvalde shooting, where one of its products was criminally used. Donald Trump gave a speech even though Texas Gov. Greg Abbott canceled his appearance.

The maker of the rifle used by the Uvalde killer went into hiding after widespread criticism.
