Peter Navarro was indicted by a federal grand jury for contempt of Congress over his refusal to comply with a subpoena issued by the House select committee.
23 in response to the subpoena and also refused to produce documents sought by another subpoena that had been issued on Feb.
The committee had reason to believe that he had information relevant to the investigation, according to the letter.
The letter cited reports that he had worked with former Trump White House advisor Steve Bannon and others to develop a plan to change the outcome of the presidential election.
On Friday afternoon, he is due to appear in the District Court in Washington, D.C., where he served as a trade advisor to the former president.
He is accused of contempt for each subpoena he received. There is a minimum possible sentence of 30 days in jail and a maximum of one year for each count if he is found guilty.
The indictment was handed down by a grand jury in Washington on Thursday and was made public on Friday.
