The New York attorney general's office said Friday that Donald Trump has failed to take all the steps required to lift the contempt-of-court order.
The contempt order requires Trump to fulfill all of the requirements by Friday. A $10,000-per-day fine against Trump could be restored if he doesn't do so.
Habba did not respond to CNBC's request for comment.
The New York Attorney General's office argued that Trump had failed to comply with a subpoena for documents as part of its civil investigation.
The AG's office is looking into allegations that the Trump Organization manipulated the values of properties in order to get financial benefits when applying for loans, obtaining insurance policies and paying taxes.
Trump was ordered to pay $10,000 per day if he failed to comply with the subpoena. If Trump met certain conditions by Friday, the contempt order would be lifted.
The office of James said that Trump complied with some of the conditions. On Thursday, Trump paid $110,000 to the AG's office, and a digital forensics company completed a required review of his files the same day.
But as of 12:14 p.m. The former president's lawyers had not completed a third condition, which was to submit new affidavits that give more detail about their search for documents.
The daily fine against Trump was imposed on April 25. It was halted after Trump's lawyers provided 66 pages of documents detailing their efforts to locate the records requested by the AG's office.
