Gary Hackbush said on Thursday that an Erie County grand jury had voted to indict Gendron, who traveled three hours from his home in Conklin, New York, to target Black residents at Tops supermarket.

After the proceeding at the Erie County Courthouse, Gendron remained silent and was sent back to jail.

The relatives of the grocery store shooting victims yelled at Gendron as he was led out of the hearing.

Gendron is accused of shooting 13 people and killing 10 at a Tops Friendly Market store last week in an attack officials are investigating as a hate crime and an act of racially motivated extremism. Gendron posted a 180-page racist rant online in which he wrote about how he viewed Black people as replacements for whites. Gendron appeared in court for the second time after pleading not guilty last week. The 10 deaths at the supermarket were covered by the grand jury first-degree murder charge. When two or more people are killed in a single event, prosecutors can only bring first-degree murder charges. Gendron will appear in court on June 9.

What To Watch For

There are additional charges. John Flynn said before the Thursday hearing that more could be filed after the grand jury investigated the shooting. The attack is being investigated as a racially motivated hate crime.

The man in the supermarket shooting was indicted by a grand jury.

Buffalo prosecutors have more time to build their case.
