In the midst of his deal to acquire the social network, Musk called on the SEC to look into the user numbers.

In an informal poll on Tuesday, Musk said that "95% of daily active users are real, humans unique." He asked if anyone had that experience, in response to a follower who suggested the SEC begin an investigation.

The SEC has been aware of the metrics for a long time.

Musk agreed to buy the micro-messaging service for $44 billion last month, but has since said the deal is on hold as he looks into fakes and bots. The transaction is still expected to go through at the agreed upon price.

The shares have been dumped by investors because they are worried that Musk will abandon his agreement and pay a $1 billion fee. Since Musk disclosed his 9% stake in the company last month, the stock has given up all of its gains.

On Tuesday, the last trading day before Musk revealed his minority ownership of the company, shares of the social network were up 2.5% to $38.33, below the closing price of $39.31.

In its first-quarter financial filing this year, the company acknowledged that there are a number of false or fake accounts on its platform. The company estimated that the average number of false or fake accounts was less than 5%.

Over the past 3 years, the company has overstated the number of users by up to 1.9 million.

The feature that allowed people to link multiple accounts together was launched in March of 2019.

In October of last year, Musk called the SEC a "shortseller enrichment commission" and in July of 2020 he called the agency a "shortseller enrichment commission".

They reached a settlement agreement with the SEC after they charged Musk with securities fraud for saying he was considering taking his car company private at $420 per share. Musk said that the financial regulator's investigations are harassment.

Musk doesn't seem to have evidence for his claims.
