The Washington Post reported Wednesday that President Joe Biden declined to assert executive privilege over an eighth set of documents requested by lawmakers investigating the Capitol riot.

The National Archives and Records Administration was given the go-ahead by Biden to turn over about 23,000 emails and attachments to the House committee investigating the riot, which has already received hundreds of pages of material from the Trump White House, the Post reported.

Some documents were removed from the batches after the National Archives decided they were irrelevant to the committee's requests.

Donald Trump tried to prevent the National Archives from handing over materials like visitor logs, emails, drafts of speeches and written notes, though it remains unknown what documents will be included in the latest batches.

This development follows Biden's April decision to waive executive privilege, a legal doctrine that allows presidents to keep certain executive branch communications secret.

A representative for Trump didn't respond to the request for comment.

Trump and his allies have repeatedly tried to avoid cooperating with the January 6 committee, which Trump has accused of being politically motivated. Biden's privilege as the sitting president outweighs Trump's privilege as the former president, according to the judge. The Supreme Court rejected Trump's request to block the National Archives from releasing about 800 pages of documents to the committee.

Some ex-Trump Administration officials could face criminal charges for refusing to comply with the committee's subpoenas. The Department of Justice charged Steve Bannon with contempt of Congress, which carries a maximum sentence of one year in jail and a fine of up to $100,000. The House voted last month to recommend contempt of Congress charges against former White House trade advisor Peter Navarro and former communications staffer Daniel Scavino Jr.
