The judge's decision to dismiss the lawsuit in its entirety was consistent with his decision to allow Trump and others to file an amended complaint.
On the heels of the Capitol riot, the social media giant banned Trump on January 8, 2021.
A group of people, including Donald Trump, the American Conservative Union, and five others, had sued the company and its co- founder Jack Dorsey last year, claiming they were unfairly removed from the app.
According to the suit, the bans were due to pressure on the company by Democratic members of Congress. The judge was asked to rule on the Communications Decency Act.
The online service providers can't be held responsible for what others post.
The ruling comes nearly two weeks after Trump told CNBC he had no interest in coming back to the micro-messaging service even if Musk were to buy it.
Prior to the ban, Trump averaged more than 30 posts per day on his account. At the time of the ban, Trump had over 90 million followers on his account.
